What to do if you are Wrongfully Terminated

If you are ever fired from a job it can set your financial goals back quite a bit. Sure, you may receive a handsome termination and severance package, but you had planned on working for more years to reach your goals. Getting fired means you may have no money coming in for a while. What really makes that sting is when you feel you were wrongfully terminated.

If there was retaliation against you for doing something that you felt was right, such as calling out discrimination or a hostile workplace, then you were wrongfully terminated as that is illegal. You would definitely have a case for some DC employment lawyers but to make sure your case is successful you’ll need to take some measures. In this article, we will go over what you should do if you feel you were part of a wrongful termination.

Get an explanation from the company

 Most jobs these days are at-will, meaning that you can actually be fired as long as you are not part of a protected class of workers. That doesn’t mean that any reason at all is valid justification. Even in states where employees are at-will you still can’t be fired for no reason.

You should get a written explanation from your company as to why you were fired. If you were wrongfully terminated then you should be able to rebut their reasons for firing you as long as you have some evidence to back it up. Continue Reading…

The touchpoint: on being “Packaged” out from the Corporation

Since being restructured out of my 14-plus-year, rather comfortable position with a global insurance company, I’ve been asked one question more than any other.

Did you see it coming? The answer in my case is yes. I suspect that’s true for most 50- or 60-somethings who’ve found themselves accepting an invitation to “the touchpoint” from their boss, only to find that it’s been moved from their office to HR at the last moment.

Of course, if you’re anything like me (which is to say that you go to work every day like a Jimmy Stewart character in a Hitchcock movie) then nothing comes as a surprise.

I had two thoughts in quick succession when I received my summons. First, what day is it? Tuesday. Dreaded dead-man-walking Tuesday.

Second, how many documents can I email home between now and zero hour? (Nothing sensitive of course, for the record.)

It’s at this point that things began to turn a bit darkly comic. On my walk to HR, I’m stopped to commiserate with a colleague about the dumb email she just got from her boss. Smile and nod.

Turn the corner and my fears are realized. The boss is sitting with a too-young member of the HR team, both sporting the kind of sympathetic look that makes you wish you’d forgotten your glasses. The transition of a leader’s career from the top of the crest to the other side can actually be a beautiful thing. This is the time when your wisdom is ripest, when the bulk of your legacy has been established, and when your influence has left a tangible and positive mark.

At this stage of your leadership career, you are a leader in full. It’s worth noting that the leadership influence of many leaders became fully expressed late in life. Benjamin Franklin was 70 when he signed the Declaration of Independence (Samuel Whittemore was 81). Ronald Reagan was 69 when he became president, and 77 when he left office. Golda Meir became Prime Minister of Israel when she was 71. Dr. Ray Irani, the CEO of Occidental Petroleum, is currently 75 years old, making him the oldest Fortune 500 CEO.

While your leadership career may span many years, the current average retirement age in the United States is 62. Given that average life expectancies have been steadily growing, figuring out what to do with all that accumulated leadership wisdom and influence before you retire, will help soften whatever butt-kicks may come when the gates of your career close. (By butt-kicks, I mean embarrassing and humiliating moments in your leadership that serve as a starting point to discover your strengths and values, and become better).

Sudden Retirement Syndrome (SRS)

Sudden retirement syndrome is not a real medical condition as far as I’m aware but for me it best describes the shock of withdrawal that occurs when a person leaves their corporate job.

This can occur through either downsizing, formal retirement or can even occur when a person is leaving after many years spent with the Corp to do something else.

The shock from going unprepared from a busy work-life to nothing can be very stressful and in extreme cases can even result in premature death. We all have heard stories of people in retirement who lost their motivation to do much of anything, started drinking heavily, and died within a short time.

I’ve known quite a few people who have suffered from SRS. My father suffered through it, a close friend died because of it, and I even had a taste of it after leaving my corporate job of 36 years — which is crazy in itself because I already had a game plan in place for my next move. I clearly remember the ringing in my ears, the feeling of uncertainty, the feeling of living in a fog for a period of time. It’s hard to break away from something that has become a piece of you over the years.

It’s important to note that not everyone will suffer from SRS. People who are able to detach themselves successfully from work when they walk out the door are usually spared. An example would be an assembly line person who is able to leave their job when the whistle blows and not think about work until the next day. While an assembly line worker may be burned out physically and mentally, as they are not challenged intellectually, the Corp does not own their soul, unlike corporate executives who are linked to their work 24/7 and whose self-identity is tied to the job that just ended.
